  • Discussing the Democratic party’s federal cannabis proposal, Cornyn said: “I don’t know what their bill looks like, but I would think it’d be unlikely (that Republicans would support it.) Marijuana’s ill effects on children and other vulnerable populations need more study.” (2022)
  • Introduced the Kenneth P. Thompson Begin Again Act, which would allow individuals who have completed their probation for a first-time, low-level drug possession offense to apply for expungement of their conviction. (2021)
  • Cornyn Said: “Part of criminal justice reform is ensuring that rehabilitated individuals are able to move on with their lives and get a second chance. Those who successfully complete court-imposed probation for low-level possession should be able to have their records cleared, and this legislation would do just that.” (2021)
  • In an email to a constituent, Cornyn said: “From 1999 to 2020, more than 920,000 Americans died from a drug overdose… I am concerned that marijuana legalization could make this epidemic worse.” (2021)
  • In an email to a constituent, Cornyn said “I believe more research should be conducted before the federal government changes its current marijuana policies.” (2021)
  • Said he worries that decriminalization, medical usage and removing marijuana laws from federal enforcement is a slippery slope “where a similar attitude would be embraced with regards to other illegal drugs and dangerous substances.” (2015)

But I think it is the prerogative of the states to make that determination. I think the people of Colorado have the right to make the decision that they’ve made under the Constitution, and as president I would respect that right.” (2016)

If you think we’re winning the war on drugs, we’re really not.” (2019)
  • While many Texas counties ceased or reduced the prosecution of marijuana possession charges after the state passed a hemp legalization bill, Sheriff Troy Nehls made it known that his county would not do the same, saying: “You come into Fort Bend County with a couple of ounces of marijuana, and you get caught with it, you are going to jail… Marijuana laws is all politics. Those states that want to be engaged can be, and it also protects our small business owners who decided that they were going to engage because they still can’t put their money in a bank, which makes conducting business less safe… Historically, there have been a disproportionate number of folks who are Black and Brown that are prosecuted for these crimes, and those numbers are disproportionate to who we know are committing the crimes. This common sense approach to alternative treatments has been opposed by Congressman Sessions, and is something I will fight to expand. Congressman Sessions’ attempts to block legislation like the Veterans Equal Access amendment is tragic. There are veterans who are suffering from PTSD and other combat injuries and could benefit from medical marijuana right now. They want it, their doctors want to prescribe it, and Congressman Sessions is standing in the way. His outdated views on the war on drugs are frozen in the 1980s. While doctors, counselors and law enforcement have come to understand that we must fight drug addiction through treatment and prevention, Congressman Sessions would rather fill our prisons with non-violent drug offenders at enormous cost. We need a smarter, more effective approach.” (2018)

Has Not Supported Adult Use Legalization In Their State

  • In response to President Biden’s announcement on the pardon of federal cannabis possession crimes in October 2022, a spokesperson for Governor Greg Abbot said: “Texas is not in the habit of taking criminal justice advice from the leader of the defund police party and someone who has overseen a criminal justice system run amuck with cashless bail and a revolving door for violent criminals,” spokesperson Renae Eze said in an emailed statement. “The Governor of Texas can only pardon individuals who have been through the Texas Board of Pardons and Paroles system with a recommendation for pardon.” (2022)
  • Quote: “We have the opportunity here in Texas to observe what is going on in Colorado and I’ve got to tell you, there are some potential upsides, but there have also been demonstrated some potential downsides to the marijuana use practices in Colorado, in California, in Washington and elsewhere. With Texas, we’ll continue to observe both upsides and downsides and make decisions in the future based on upon our assessments at the time…. I have observed in California where it was used for medicinal purposes before it was allowed for recreational purposes, and when it was used for medicinal purposes in California, what they did is they set up pop-up tents up and down the beach. And anybody could go get it. So just because it’s used for quote, ‘medicinal purposes’, doesn’t really mean that it would be limited to that because of the way doctors would use it, they would provide medicinal permission slips for anyone who wanted it. And so don’t think that just because it’s for quote ‘medicinal purposes’, it would be limited to such.” (2017)
